. (1) For the purposes of sub-section 1 of section 17 of the Act, an Electricity Tariff Determination Commission shall be formed to determine the electricity tariff and other charges to be collected from the person providing such service for the electricity service provided by the Government of Nepal or a person who has obtained a license, consisting of the following chairman and members: –
(a) Non-governmental person appointed by the Government of Nepal Chairman
(b) Representative Member of the Ministry of Water Resources (c) Non-governmental economist member appointed by the Government of Nepal (d) Among the persons who have received the license to produce, administer or distribute electricity, the person who has received the license specified by the Government of Nepal or his representative member
(e) Representative member of Nepal Confederation of Industry and Commerce
(f) One individual member appointed by the Government of Nepal from among the customers (2) The Director General of the Electricity Development Center shall be the Secretary of the Commission and the Secretariat of the Commission shall be done by the Electricity Development Centre.
(3) The Commission may invite relevant experts as observers to the Commission meeting (4) The term of office of the chairman and the members as per clauses (c), (d) and (f) of sub-rule (1) shall be three years and the term of office of the chairman and members whose term has expired can be extended for one more term.
(5) The Government of Nepal may, by publishing a notice in the Nepal Gazette, modify or further reduce the number of members as per sub-rule (1).
